Jay Bybee was President Bush's nominee to fill a vacancy on the 9th Circuit Court of Appeals, serving most of the West. Progressives were angered over the nomination, because they submitted repeated questions to Bybee about his legal views and received evasive answers or no answer at all. This left them without a clear sense of his judicial philosophy, though his position as Assistant Attorney General under John Ashcroft left them with little doubt that this philosophy would be very conservative. They voted "no" on the nomination, but Bybee was confirmed 74-19.
